The rule, exactly. Before an election each citizen chooses: to vote — or to take a payment and not vote in that election. The payment is a percentage of the median income, set by referendum; there is no fixed sum. One ballot is one vote, with no multiplier in the count; the vote is amplified only in that each ballot's share grows as others step out. The budget pays under law; a candidate never pays. Only a referendum of all citizens — simple majority, no quorum — introduces, changes or repeals the rule.
The protocol has been introduced nowhere and no pilot has been run: shares, turnout and outcome figures in the chapters are estimates, and the protocol promises nobody an election victory. If a chapter says otherwise, Exact Answers and the Charter are correct. For a candidate: ten questions and ten steps. AB-EXIT and the Capture of Institutions: an Answer to Ernst Fraenkel¶

How to read this chapter (note of 02.10.2026). The text contains wording that is easy to misread: a "reversible" choice means "at the next election": within one election exit is final. The exact-answers sheet 1d and the charter 048m are in force.
Purpose¶
Ernst Fraenkel ("The Dual State", 1941; post-war neo-pragmatic pluralism) is the most dangerous institutional critic of AB-EXIT. He strikes not at the economics (that flank is closed by the section on Henry George) but at the mechanism's stability over time: what will happen to AB-EXIT in the hands of a bad-faith power. The section's result: of his three blows two break on facts and the text of the protocol; the third is accepted as an engineering requirement of constitutional level.
Fraenkel's optics¶
Normenstaat vs Maßnahmenstaat. Analysing Nazism, Fraenkel showed the coexistence of the normative state (laws, predictable rules) and the prerogative state (arbitrariness "by expediency") — and that the prerogative can always swallow the norm. Pluralism: a healthy democracy is institutionalised open conflict of groups within an "undisputed core" of common values. His criterion: does a reform strengthen the norm and open conflict — or create a zone of prerogative and muffle conflict.
What Fraenkel would approve¶
A formula dividend changeable only by referendum — pure Normenstaat against discretion. Direct payment bypassing the official-distributor — a narrowing of the existing prerogative zone. Recognition of the legitimacy of non-participation — anti-totalitarian (totalitarianism demands 99 % turnout).
Three blows¶
Blow 1 — "you have created a syringe". A payment register tied to political behaviour is ready infrastructure for a future autocrat: reward the loyal, punish the disloyal "by budgetary necessity". Weimar with impeccable laws generated prerogative through Article 48.
Blow 2 — "you muffle conflict instead of institutionalising it". Removing 30–40 % of citizens from electoral conflict for money = depoliticisation; unrepresented conflict accumulates outside the rules and breaks through outside the rules.
Blow 3 — "equality of the vote is taken out of the undisputed core". Variable weight moves one person, one vote from "not up for discussion" to "depends on choice"; once shifted, it is easier to shift further.
Analysis¶
Blow 2 breaks on the empty chair. The argument presupposes that the citizens being removed conduct a represented conflict. There is none: 48 % left by themselves, for years, for free — their non-participation today is a mute zero the system ignores. AB-EXIT does not remove them from the public sphere — it records an exit that has already happened and turns the mute zero into a registered, paid, reversible act. A person who previously simply did not come makes an official choice B — this is a growth of representation. Whoever wants conflict refuses the money and gets a strengthened vote: the channel is open, and in it are those who really want to be there.
Blow 3 softens to a frame. AB-EXIT makes equality activatable: everyone is offered an identical choice (equality of opportunity); weight is the consequence of a free reversible decision, not of status by birth or income (unlike historical qualifications). The honest price remains: "equality that requires activation is no longer an undisputed core." The answer: the reversibility of every cycle keeps the principle closer to the core than any irreversible qualification; everything is introduced and abolished only by referendum.
Blow 1 — remains, and rightly so. Capture of the payment mechanism is a real risk that cannot be argued away. The answer is constructional, safeguards of constitutional level: (1) a formula lock — parameters change only by referendum; (2) a public payment register — selective "suspension" is visible immediately; (3) an autonomous trust — the executive does not touch the money; (4) protection from election interference (§44). Additionally: the risk of budget capture already exists now — in the form of opaque administrative rent without formula or register. AB-EXIT does not create the risk; it replaces an existing opaque capture with a transparent mechanism that is harder to capture. (Cf. §13.12: every incentive machine required the completion of its frame — the safeguards are built into the core from day one.)
Quantitative balance: risk against signal cleansing¶
The risk and the benefit live in different tenses: the cleansing is immediate and every cycle; capture is deferred and conditional (a coincidence: an autocrat in power × the formula lock broken × the register broken × the referendum threshold broken; each factor < 1).
A model estimate of the cleansing (method: segmentation §17, Alaska PFD empirics §14, Shapley §13):

Signal-to-noise grows 2–3 times; the share of consciously cast deciding votes: from ~40 % to ~65–70 % (+15–30 pp). Caveats: in poor economies some pragmatists will take the dividend (the lower bound); "aware" = resistant to manipulation, not "objectively right"; manipulators adapt, but targeting an aware electorate is more expensive and slower.
Fraenkel's verdict (reconstruction)¶
"The idea narrows arbitrariness in the present — that is its merit, and no small one. But it creates a payment institution tied to political behaviour and moves equality of the vote from the undisputed core into the zone of choice. In the hands of a good-faith democracy it is a cure; in the hands of a prerogative state — a ready syringe. Build it, but build in safeguards against yourselves."
The project accepts this as a technical specification: the safeguards are part of the core, of constitutional level, designed before the mechanism itself.
